Caught Speeding (again). Advice please

Post by JohnH79 »

Been driving for about 14 years now and riding motorbikes for 4 years. It's been rare that I have had a completely clean license, normally have 3 points on it at any one time. Maximum it has ever been at is 6 points and it's always for speeding. I got caught in the Coupe just over a year ago so have been sitting on 3 points since. I got caught in the M3 about a month ago and got clocked at 36 in a 30. Didn't actually even think I was speeding and thought I might get let off, but didn't. Got the chance to go on one of these wonderful speeding courses for the cost of £74, but because of this didn't get any points which was a big plus. Did the course yesterday and it wasn't actually too bad. A little patronising but actually quite informative and I did actually learn some useful stuff. They actually let slip an interesting fact that any mobile speed camera/hand held radar gun shouldn't be used at night as they cant calibrate them properly in the dark! Useful to know that at night you should only get caught by a fixed site camera or by a traffic Police car. Anyway, I digress......

When I got home from the speeding course yesterday I had a letter on the mat from the Police. I had been caught by a camera van, which I had seen (but obviously not in time). How ironic that I get home from the speeding course to a speeding ticket eh??! It was from about a week ago and was on a nice straight dual carriageway (70 limit) and they have clocked me at 93mph!! Not good! I have received the usual NIP (Notice of Intended Prosecution) which asks you to fill out the details of the driver and send it back. As I mentioned before, already have 3 points on my license and just attended this speeding course yesterday, so it stays at 3 points, but does anyone have any idea what I will get for this latest one. A couple of my mates reckon I will get banned, someone else said 6 points, someone else 5! Another mate said I will definitely get a court appearance. Are there any specific guidelines of speed against Fixed penalty notice or court summons? I have done a bit of research online and a couple of sites seem to suggest 95mph or over (in a 70 limit) is a court summons. Yet I was doing 93. Any one got any personal experience with this? Obviously the best result for me would be no points, but that is not going to happen! So the next best thing would be a Fixed penalty and 3 points.

Before anyone says it, I know speeding is inherently wrong and I know I need to slow down. But I'm sure 99% of people reading this have/do speed at some point. I assumed that I would be caught on my motorbike if anything as it is much 'easier' to speed on that. If I get any more than 3 more points (or obviously a ban) I think I need to sell the bike to 'minimise' any further risk (I find it much much harder not to speed on the bike than I do in car)!

You will have to go to court by the sounds of the speed, and the judge will most likely ban you for you background of speeding.

Depends who you get on the day though mate.

Off topic but that white Coupe looks awful.

On topic ish, I was only remarking during the week that I'm amaxed I have never been caught speeding, in 10 years and 160K miles I speed most days :sorry:

Best of luck, you don't seem to have that bad a record really, the fact you have done a course may stand to you in court.

tbh you will probably get a 3 or 6 point fixed notice.

u usually only go to court unless you will be banned due to totting up ( like me)

or if its 30 or more than the set speed limit.

it is a instant ban if you are doing 30 + above the set speed limit and its down to the magistrates to decide how long.

i doubt your have to face a court, unless u choose to. which you can opt for . but ur face court costs and possibly a bigger fine. which i dont advise you to do

if you do, my old man used to be head of Hampshire traffic and mums still in the force. and i can point you into the correct direction you will need to take in court.

ie what u need to plead.

every one speeds at the end of the day its not right but whats done is done . im personal friends with alot of high ranking officers in Hampshire and i can tell you know not one of them hasnt been done for speeding . or has a clean license.

One of my mates knows someone caught on the motorway doing 96mph on his bike and he had to go to court and got banned for 6 months. I have now been on a couple of sites that suggest 30mph over the speed limit is nearly always a ban. I was 23mph over the speed limit. Another couple of sites seem to suggest 96mph+ is a court summons, i was doing 93mph.

This web site seems to suggest it should just be a fixed penalty:

I really want to believe this!!! Although it could be out of date now as it was from July 2006

I did a drivers improvement course when I had a crash. Got told I was reckless driving and excessive speeding and was going to take me to court for either both or for just the one (depending on what they could prove).
I paid £160 to do this course and was told your only entittled to do this course once every 3 years.
I think this would be the same for your course too, so if your lucky enough to get away without going court,

Make sure you dont get in trouble again

I wouldnt try not to think about the outcome as it is out of your hands and like already said, it depends on whom is overseeing what.

I'm sure there is almost a judge in every city whom had a loved one or something involved in a speeding accident or whatever.

Deal with it when it comes up.

look honestly u prob wont have to go to court . and even if you do it was 7 months before i had to go after my last ticket as i had got to 12 points.

and ur mate may of got 6 months but you will never no his previous track record and in all honesty he prob got banned for 6 months due to totting up like me as he woudl of got 6-9 points for it and 6 months is the set period for totting up ( getting 12 points or over ) unless you can plead imitigating circumstances. and by this i mean some one else will be effected by u loosing ur license . financial side of things are not considered im affraid

if you do go to court let me know and i can help you out.

but im pretty sure ur get a fixed ticket . ill get my old dear to check tonight for you.

i got a 6 month ban due to totting up becuase im single no kids and no mortage.

a lad in court before me was doing 112 on the motorway and got 2 weeks due to the fact he had kids and needed his licence for his job and if he lost it there went his house and kids out on the street and gave all that rubbish.

honestly dont worry about it. whats done is done ur still alive arnt u

i was done last year for playing around with a r32 which was a unmarked copper  put on my ticket i was doing 64mhp in a 30mhp and it ended up having 3 points and a fine. i cant say how quick i was going but it opened my eyes alot!

not the rule of the book but i think it goes on the mood of the copper/court room and if you come over to them like a cobbler or not, i saw i kid who got pulled by a copper give him some lip, he walked away with 3 points and £60 fine plus a nice talking too

just to add, the kid was pulled for parking in a clear way

you avoided ur ban due to the walking sticks . as she would be effected from you not driving.

letters from employers are only a character thing and have no real effect on the out come.

in such cases you only avoid bans due to mitigating circumstances . job loss or financial loss is not counted as such.

unless your loss of job would say stop u paying ur mortgage and put your kids out on the street etc

my friend got caught by a copper with a handheld gun on a motorway bridge.

107mph in a 70 limit,

took it all the way thru court and got 4 points after arguing that the hand held guns arent supposed to be used from a raised aera/bridge pointing down towards cars.

still better than a ban!

(I should stress this was at 3am on a monday morning and the roads were empty, but yes, I was driving like a c*ck... I really had to get somewhere fast)

They give out fixed penalities (3 points and £60*) for all sorts nowadays because it's quick and profitable for them. So I'd cross your fingers and hope that comes back rather than them referring it to court.

I imagine policy varies across the country as to what speeds they will issue a FP for, but you hear many cases of speeds high than what you were caught at.

I got 118 on a motorway, but got done by an armed response unit. They had to use the average of the speed they were trailing me, which turned out to be 101, and i got 3 points and a fine.

Got pinged for a second time the other week 45 in a 30.

I got pulled by an armed response unit once for 90 on the motorway... they were about to start writing the ticket when they had a call about, and I quote, '4 men with turbans on in a pickup truck full of gas cannisters' and buggered off sharpish.
