Bloody egay again
So you sell something, with a clean and clear picture, and even tell people it has damage.
Some cobbler then decides to bid on it, and complain when it turns up "i paid a lot and it is damaged, not happy, want a refund".
It frigging well said in the advert it was damaged you retard. Jesus why can't you neg these idiots. Awaiting inevitable and unavoidable paypal claim now. ¬_¬

Re: Bloody egay again
Surely you'll have some comeback on this one as Paypal will be able to view the original auction and see that you had clearly advertised it correctly.

Re: Bloody egay again
He's claiming it has other damage, which is odd, as I certainly wouldn't have sold it if it wasn't fit for purpose.
He seems to be missing the point that the trim can still be damaged, but fit absolutely fine ane never be noticed.
His actual words included "i've paid a lot of money for this item" to which I simply replied yes, I appreciate that, but it was your choice to bid!
Trouble is, you know as well as I do he'll force a paypal dispute, so god knows where I stand. Tempted to take that piece of trim off my Peugeot and send proof to Paypal it wasn't damaged, heh.

Re: Bloody egay again
state your case....make him show the 'other damage' to paypal...keep your fingers crossed and pray that paypal see things in your favour when the decision is made.
Sounds to me like you're in the right so I would think you're ok.
I've won a few paypal disputes before now...just don't lose your rag in the dispute and make sure you clearly state to them all they need to know to get the decision you want.

Im currently running a dispute in ebay due to non delivered item and havent received the item I ordered off another website (not ebay).
Some sellers/buyers are like communicating with a brick wall/an idiot! and it takes one or 2 of these bad experiences to put me off buying things on the internet again to be honest...
It really does rile me up life is too short for bullcrap like this. Am i right everyone
Whats the item number so we can have a nosey at it?...

Paypal is already emptied since I had 4 large transactions off here in the account, but as said above they freeze your account anyway, and then auto debit it from your bank.

Re: Bloody egay again
I swear people dont read the discription, just see the title then bid. I've got one at the min. Sold a tyre clearly in the dicription it said it was one tyre only and it had had a puncture repair, also the pic only shows one tyre. I send it the guy and now he's moaning because he thought it was 2 tyres and no puncture repairs.
I think aslong as you mentioned it in the discription paypal cant do anything as the buyer cant complain about things that they should of read before bidding.

I could have sworn that paypal can't take money out of your bank account? Hence why people end up waiting years for a refund, because the cash isn't in their paypal account.
Wouldn't it count as an unauthorised transaction on your bank card?

Re: Bloody egay again
doesn't suprise me at all. I've had a few people buy from me on other forums and ebay, and then complain when it turns up that it wasn't what they expected. It almost feels like they were never that interested in the item in the first place, but somehow "get off" on leaving negative feedback and attempting to ruin someones rep.
Not being able to leave negative feedback for non-payers really winds me up as well. Not long after ebay changed the rules, I listed a set of alloys. Someone clicked buy it now, obviously didn't read the ad properly, and asked me to courier them (which i'd said in the listing was not an option), then never got back in touch, and 2 days later, bought another set of wheels from someone else. I emailed ebay customer service about it, but it seems that all they do is copy and paste the terms and conditions and reply with that, instead of answering the question. It's definately put me off selling on there.

Re: Bloody egay again
Yep both Berger and I have been stung like that in the last month, and you can't strike them as a nonpaying bidder for over a week.
He's a total retard, he cannot construct a sentence properly so is clearly a chav.
I just sent this to him:
Paul,
This item was installed in my car for over 100,000 miles, and it never ever rattled in mine. Tabs aside, I fail to see how you have managed to get it to do this - these clips are a ridiculous interference fit, it would stay in place with 1 clip, I know this as my friends only had one on when he bought his car.
Ebay does not require any seller to offer a refund facility - my advert did not offer a refund option and you will have been aware of that before bidding. If you insist on sending it back you agree I will reimburse the auction amount, but not the postage amount to send it there/back. I would not have sent the item if it was fit to achieve it's purpose, and from the amount of time the item I sent spent in my car I was satisfied it was.
If you accept the above and choose to do this, then send the item to:
My house y0
Upon receipt of the item, I will credit the winning bid figure back to you via Paypal. Please note you should expedite this parcel with haste, as I will be travelling for work on March 16th.
Regards,
Simon
If he doesn't like that he can paypal my donkey boy y0. Credit card removed already and thoroughly emptied as it had nearly 500 quid in heh.

If you lose the dispute and there isn't enough funds in the account to cover the refund then they'll just put your account in the red. They won't touch your bank account, they can't. You have to give permission with withdrawals from your bank and I sure as hell wouldn't give it.
I'm on the consumer action group forum and this happens all the time, paypal are always upsetting people.
If your account goes into the red and you don't pay they'll sell the debt to a very annoying debt collection company. I've know paypal to do this for as little as £15.00

Re: Bloody egay again
....and here is the Paypal claim.
Paypal automatically put my account 35.59 into the Red. Buyer claims I am not responding. However, I think he has just shot himself in the foot on paypal.
His first disgruntled email to me states:
"hi it arrived today, how ever iam not entirely happy with it, the plastic tabs that the metal clips fit on to hold the plastic to the dash have bin snapped. 3 out of 5 are snapped! could be solved with glue i guess but as i have paid alot for this i expected it to be in perfect condition. so can i have your adress to refurn the item for a full refund. regards paul"
His Paypal claim states:
"item arrived but i is broken, the plastic tab that holds it in place are all snapped! i have tried contacting the seller to arrange a return but no luck so far"
Notice that it's gone from 3 of 5 being broken to 5 of 5 being broken, and i'm being accused of not responding. Also of note is of a total winning bid of £36 inc post, he's claiming a £17 refund - which I have queried.

Re: Bloody egay again
That sounds like that's what he's put into the dispute console which is designed to be a communication tool between buyer and seller to help resolve it without paypal having to make a decision. He clearly thinks paypal are actualy going to consider what he types into it when chosing who to back. What a prat
How is he only claiming £17? the claim should be for the full amount, I've not know them to make up their own figure before?
Keep in mind that the paypal decision is not the be all and end all, if they give it to him then you can still apply to court and win. It's happened many times. People are just catching on to it now, trouble is that paypal and ebay in partnership make out that what they say is final and that it's law, but it isn't always the case

Re: Bloody egay again
The auction describes damage to the front of the panel, which is all any sane person would care about. I do not recall it having clips missing from the rear else i'd have advertised as such. He's a total chav, you should see him attempts to write a scathing comment, it's laughable.
I've already told him if he sends it back he can have the winning bid back, but i'm not funding the postage there or back.

A true lying gimp.
Paypal are holding your money as standard practice, it don't mean the theiving gypo is going to get his hands on it.
IF they decide in his favour he will still have to send the item back to you by recorded delivery at his own cost, this can be by carrier that is on the paypal approved list.
so either way, the bloke is going to have to pay to send it back to you. LOL, maybe he doesn't realise what paypal are going to instruct him to do, he probably thinks they're just going to give him YOUR money and let him keep YOUR item, have no fear, that will not happen.

He knows full well you won't get half way accross his council estate without the wheels being taken off your car at traffic lights.
C2K ifa paypal dispute is opened and it should be then it's for paypal to decide...If you described the item as damaged originally then he has no come back.
You send them all the mail correspondence you've had and I don't see how you can lose this one...even if paypal are mongtards.
They'll see he's lied about you responding and so most will likely have lied abou the item.
Re: Bloody egay again
well, whatever happens, I get the feeling that he is correct. All the plastic clips ARE broken.
I don't mean you're lying. I mean he's now busted them. You'll get it back completely knackered by the sounds of it
Have you threatened him with small claims court yet? 9/10 that makes them think twice and if he ignores you and you do it then again 9/10 they wont defend the case and you'll get your money back. I don't beleive in Paypals decision being final, because it just simply isn't.
